The following terms and conditions are made by and between Medirect, LLC of Chicago, Illinois (referred to as “eKneewalker”) and the Renter/Purchaser of any of the products available via eKneewalker.com.
By renting or purchasing any of the products available from eKneewalker.com, the Renter/Purchaser agrees that he/she has read, comprehends, and agrees to all terms, conditions, and policies listed below and on eKneewalker.com. Use of the products rented/sold through eKneewalker.com is strictly prohibited without agreeing to these terms and conditions.
The Renter/Purchaser hereby agrees to rent/purchase from eKneewalker a wheeled knee rest/crutch alternative referred to as “knee walker” and/or any of the products available for purchase via eKneewalker.com.
Initial payment will be charged for the agreed upon terms above by Medirect, LLC. Each additional week after your first month will result in a charge of $35, with a daily charge of $5 for midweek returns. Your rental period ends the day your package is scanned for return. You will not be charged for time in transit to our facility.
By signing the rental agreement, Renter understands it is his/her responsibility to read and follow the manufacturer’s instructions for operation and safety of the knee walker unit provided by Medirect, LLC. Renter agrees to the terms of payment detailed above and understands that there are no refunds after 7 days. Any damages above normal wear and tear to the rental unit may result in additional charges.
Medirect, LLC does not in any way guarantee that their customers will be reimbursed by their insurance carrier and cannot submit claims on behalf of an individual. Medirect, LLC assumes no liability for any injuries or damages arising from the use or misuse of this product. If any questions arise, Renter should contact Medirect, LLC at 855.662.7882.
2) Shipping to Renter
If the Renter has paid for UPS “expedited” shipping and the knee walker is not delivered on the rental start date due to an address correction or late shipment error caused by eKneewalker, through no fault of the Renter, eKneewalker will credit the rate difference for the UPS expedited shipping service received based on delivery date once delivered.
3) Rental Fees / Extending Rental
The Renter agrees to pay in advance for the entire rental period, including any subsequent weeks beyond the initial rental period. If the Renter terminates the rental for any reason prior to the expiration of the pre-paid rental period, the Renter will be credited the full unused week(s) of the pre-paid rental, provided it is after the four week minimum.
To extend the knee walker rental contract beyond the previously agreed upon rental end date, the Renter must notify eKneewalker prior to the end of the rental period. The Renter may choose to rent the knee walker for additional week(s) at the weekly rate agreed upon at the start of rental. The Renter agrees that eKneewalker will automatically charge any credit card on file provided by the Renter the weekly rate agreed upon at the start of rental, if the rental is seven days past the current rental end date and the Renter is still in possession of the knee walker. The Renter agrees that if the knee walker is returned between the rental end date and seven days, eKneewalker will automatically charge any credit card on file provided by the Renter a daily rate of $5.00. The Renter will be provided with rental extension documentation via email reflecting the new rental end date.
The Renter agrees it is his/her responsibility to convert the rented knee walker to a purchase by notifying eKneewalker of his/her intention to purchase. eKneewalker will then provide confirmation of the knee walker purchase. eKneewalker will not automatically convert any Rental to a purchase unless expressly notified by the Renter.
4) Returning the knee walker
The Renter is responsible for returning the knee walker at the end of the rental period to eKneewalker at the address provided, at the Renter’s expense. It is the Renter’s responsibility (if purchased by Renter) to notify eKneewalker if the UPS shipping label is not included with the rental paperwork upon delivery. It is the Renter’s responsibility to ensure he/she mails the knee walker, at his/her own expense, in time to return the knee walker by the agreed upon date. The Renter will be charged for every week the knee walker is in his/her possession beyond the initial rental end date.
eKneewalker is not responsible for arranging the return of the knee walker beyond providing the Renter with the prepaid UPS return label (if purchased by Renter) to be affixed to the original packaging. It is the Renter’s responsibility to return the knee walker on time by mailing the knee walker to the address provided on the UPS return label, or scheduling a UPS pickup at the Renter’s expense, in addition to the return shipping charges.
5 End Rental Shipping
If the Renter chooses, he/she may contact eKneewalker to arrange for a UPS home pick up by contacting eKneewalker via phone at 855.662.7882 or email at questions@eKneewalker.com. The Renter will be responsible for the $13.00 pickup fee. eKneewalker reserves the right to charge the pickup fee to any credit card provided by the Renter. If the Renter arranges a UPS pickup and charges it to eKneewalker’s shipping account, eKneewalker reserves the right to charge the Renter’s credit card the $13.00 pickup fee.
The Renter will return the knee walker in the box originally provided to the Renter at the beginning of the rental period. If the Renter uses a different box to send the knee walker back, the Renter acknowledges that they will be charged for any additional fees due to dimensions other than those of the original box provided by eKneewalker.
The Renter agrees that for up to 7 days after the rental start date he/she may choose to exchange the knee walker for a different size of the same model free of charge. If the Renter chooses, they may expedite the shipping of the exchanged knee walker at an additional cost to be charged at the time of exchange.
An exchange may be made free of charge one time only.
The Renter agrees that only one knee walker will be in the Renter’s possession at any time, unless during the time when an exchange unit is delivered to the Renter. The Renter may keep the original knee walker until the exchange knee walker arrives. After the arrival of the exchange knee walker, the Renter has 2 calendar days from the delivery date of the exchange unit to send back the original knee walker. If the Renter fails to drop off the original and is subject to a Security Deposit of $100 until the original knee walker has been dropped off and scanned into the UPS system. The date of drop off will be verified through the UPS tracking system. Any and all additional exchange/shipping fees will be charged to any credit card on file provided by the Renter.
The Renter may cancel the knee walker for any reason by contacting eKneewalker for a full refund provided the knee walker has not shipped.
Once the Rental/Purchase has shipped, the Renter/Purchaser may cancel the Rental/Purchase for any reason within the first five days of the Rental/Purchase. The Renter/Purchaser is required to accept delivery of the UPS package even if the Renter/Purchaser cancels the rental. Once the knee walker is received by eKneewalker, a credit will be issued for the remaining rental fees and security deposit returned by credit card provided by the Renter/Purchaser within 10 business days from the date the knee walker is returned.
eKneewalker must be notified of any cancellation via phone within five days of the rental start date. The Renter/Purchaser must drop off the knee walker at any UPS location within the five day cancellation period. The rental ends on the date the Renter drops off the knee walker to any UPS location. If the knee walker is kept longer than the five-day cancellation period, the rental will be considered active and no longer cancelled, at which point and the original four week minimum will apply. If the Renter or Purchaser returns the knee walker within the cancellation period without notifying eKneewalker via phone, the cancellation of the Rental/Purchase is void and the Renter/Purchaser will be charged the four week minimum rental requirement.
After five days from the Rental/Purchase start date, the Rental/Purchase cannot be cancelled for any reason. No refund will be given for any of the rental fees paid for the first four weeks of the rental or total purchase price. A refund will be given for any weeks paid beyond the four week minimum if rented. All shipping fees are nonrefundable.
9) Switching From Rental to Purchase
The Renter agrees that he/she may purchase the knee walker at the list price on www.eKneewalker.com at the time of their request. The Renter may apply four weeks of rental fees towards the list price of the knee walker. The Renter agrees it is his/her responsibility to convert the rental to a purchase by notifying eKneewalker if he/she wishes to do so. eKneewalker will provide confirmation of the knee walker purchase at that time. In the event the rental exceeds the list purchase price of the knee walker by more than $140, the Renter authorizes eKneewalker to automatically convert the Knee Walker rental into a purchase, less the applicable rental fees by using the credit card on file. Shipping costs cannot be applied.
10) Condition of knee walker
The Renter/Purchaser agrees that upon receipt of the knee walker, it will be examined and deemed to be in good working condition. It is the Renter/Purchaser’s responsibility to return the rented item to eKneewalker in the same condition, except for ordinary wear and tear. If the knee walker is damaged when received, the Renter/Purchaser must notify eKneewalker of the damage within three business days to verify the claim. If eKneewalker is notified any later than three business days, eKneewalker reserves the right to hold the Renter/Purchaser responsible for the damage to the knee walker.
The Renter/Purchaser agrees that if the Renter/Purchaser has questions/concers regarding the provided instructions, the Renter/Purchaser is to contact eKneewalker at 1(855) 662-7882 before use. The Renter/Purchaser agrees to read and adhere to the safety instructions provided by eKneewalker and/or the knee walker manufacturer prior to first use. Using the knee walker in any way other for its intended purpose as a crutch alternative is prohibited.
The Renter/Purchaser agrees to responsibility for the knee walker product provided by eKneewalker. The Renter/Purchaser assumes all risks inherent in the operation/use of the item and agrees to assume the entire responsibility for the defense of, and to indemnify and hold eKneewalker harmless from, and hereby release eKneewalker from any passive and active negligence, strict liability, intentional act, willful misconduct or gross negligence, and all claims for damage to property or bodily injury (including death) resulting from the use, operation, or possession of the item, whether or not it be claimed or found that such damage or injury resulted in whole or in part for negligence, from the defective condition of the item, or from any cause. The Renter/Purchaser agrees that no warranties, expressed or implied, have been made in connection with this rental or purchase. The Renter/Purchaser agrees that these terms and conditions and the rights of the parties listed shall be governed by and interpreted in accordance with the laws of the State of Illinois.
13) Equipment Responsibility
The Renter/Purchaser agrees to be responsible for the knee walker from the time the knee walker is in or left at the Renter/Purchaser’s possession from delivery, until it is placed in the possession of UPS at the end of the rental.
14) Lost, Damaged or Stolen
The Renter agrees if the knee walker is lost, stolen, or damaged under any circumstances while rented, regardless of fault, The Renter shall be responsible for all charges, including labor costs, to replace or repair the knee walker. If the item is lost, stolen, or damaged beyond repair, or not returned, the credit card provided by the Renter will be charge the full list price of the knee walker as listed on www.eKneewalker.com to replace the knee walker. eKneewalker reserves the right not to re-rent to the Renter in these circumstances, and can terminate the rental.
15) Failure to Return the knee walker
The Renter agrees if the knee walker is not returned and the Renter is not in communication with eKneewalker, the Renter will be pursued for all monies owed in addition to the list price of the knee walker as stated in this contract. eKneewalker will report the knee walker stolen by the Renter to the Renter’s local police department. In addition, eKneewalker will pursue the Renter via a Collection Agency to recover the fees and the list price of the knee walker. The Renter agrees he/she will be responsible for all costs in the recovery of the knee walker in his/her possession including, but not limited to, all attorney fees and expenses, should the Renter fail to return the knee walker.
16) knee walker Failure/Breakdown
The Renter/Purchaser agrees to immediately discontinue use of the knee walker should it at any time become unsafe or in a state of disrepair and will notify eKneewalker of such circumstances within one business day. eKneewalker agrees at its discretion to (a) make the knee walker rental operable within a reasonable time by sending replacement parts or giving instruction on how to adjust the knee walker, or (b) provide the Renter with a replacement knee walker, sent via UPS at the previously ordered shipping rate. This provision does not relieve the Renter from the obligations imposed by other paragraphs in this contract. In all events, eKneewalker shall not be responsible for any injury or damage, including consequential damage, resulting from defect of the knee walker.
17) Modification of Terms and Conditions
The Renter/Purchaser agrees this document represents the entire Terms and Conditions of his/her rental/purchase, and there are no collateral, oral, or other agreements outstanding. Any extension of the terms of this contract may be made only in writing and signed by both the Renter/Purchaser and eKneewalker and made a part of this contract.
The Renter hereby authorizes eKneewalker to charge any credit card on file provided by the Renter for the initial $100 security deposit, rental fees, extensions, and any fees owed at the end of the rental period as per this contract. The Renter understands eKneewalker is not a Medicare provider, and it is the Renter’s/Purchaser’s responsibility to pay for all rental/purchase costs. The Renter understands that if the knee walker is not returned, a credit card will be charged the full list price of the knee walker as per this document. By accepting the knee walker, the Renter/Purchaser attests to being the card holder or an authorized user of the credit card(s) given to eKneewalker. In addition, if any balance is owed, eKneewalker will hold the Renter’s final invoice until the balance owed is paid in full. eKneewalker reserves the right to charge any credit card on file provided by the Renter until the balance is paid in full.
